These Luminar Neo Generative AI Guidelines (Guidelines) establish the mandatory rules you must abide to use Luminar Neo Generative AI features, and are incorporated by reference into the End-User License Agreement (EULA) located at https://aperty.ai/legal-eula#end-user-license-agreement. All terms used but not defined in these Guidelines have the meaning given to them in the EULA.
The purpose of these Guidelines is to ensure the quality of the content generated with Luminar Neo Generative AI features, and a safe, ethical, and trustworthy environment in the developing world of AI.
Your use of Luminar Neo Generative AI features must be limited to the production of your creative work. Using Luminar Neo Generative AI features for the training of any AI/ML models is expressly prohibited.
This implies that you are not permitted, and are not allowed to permit third parties, to employ any content, data, Output, or any other information obtained or derived from any Luminar Neo Generative AI features, in the direct or indirect creation, training, testing, or enhancement of any machine learning algorithms or artificial intelligence systems, which includes various architectures, models, or weight configurations.
When using Luminar Neo Generative AI features, you are not allowed to create, use (including as an Input), or attempt to do so, any illegal, offensive, confidential, private, or unethical content, including, but not limited to:
When using Luminar Neo Generative AI features, you must care about the rights of third parties, including, but not limited to, intellectual property rights, privacy and publicity rights.
Do not create, use, or attempt to do so, any content that violates third-party copyright, trademark, patent, privacy, publicity, or other rights.
In particular, you explicitly prohibited from using, or attempting to do so, Luminar Generative AI features to create Output that is a copy, has substantial similarity, follows the style, or is otherwise substantially influenced, by another person’s work. For example, requesting the Output that is "the same as", “similar to”, or “in the style of” Erwin Olaf or any other real person / real work is prohibited. The only exception is if the author deceased, or the work was created, earlier than 120 years ago.
If you’re not sure whether your content violates third-party rights, consult with an attorney or refrain from using such content.
You are not prohibited to use the Output from Luminar Neo Generative AI features for commercial use if you did not violate these Guidelines or the EULA.
At the same time, as legal framework regulating AI is still evolving, using the Output for commercial purposes may be tied with higher risks, including, but not limited to, the risks of violating third party intellectual property rights.
We recommend applying great care when using the Output for commercial purposes, and in case of doubts in respect of any particular Output, consulting an attorney or refraining from using it commercially.
Remember that you are fully and solely responsible for any consequences of using the Output. We do not assume any responsibility for the Output generated by you.
We may mark the Output as being generated by AI by adding relevant metadata to the Output files or otherwise.
We encourage conspicuous disclosures about the Output being AI-generated to ensure transparency and distinguish it from human-created art.

Violation of these Guidelines or other terms relating to the use of Luminar Neo Generative AI features may lead to restriction, suspension, or termination of your access to the Luminar Neo Generative AI capabilities, or termination of your license to Luminar Neo, without compensation and prior notice, and, in case of serious violations of law, may result in you being reported to law enforcement authorities.
